School choice is spreading everywhere in North America because of a growing awareness that public education has lost its way. Religious schools often offer a better alternative, and they might be even more popular were it not for the cost.
Hitherto, progressives have sought to prevent voucher programmes from being used at religious schools.
But the First Amendment does not allow the state to discriminate on the basis of religion.
This 7-2 decision upon Trinity Lutheran was related to funding school playgrounds. Opponents argue that it only applies to such non-educational purposes.
“But in his concurrence Justice Neil Gorsuch wrote that the Court’s playground decision should be understood broadly because jurisprudence must be governed by general principles.”
The myth of state neutrality is ending. There’s a long way to go yet.
